Employment Law Update 2014


2013 saw some of the biggest changes to Employment Law  including:-
  • The new consultation period for collective redundancies 
  • Changes to the rules on Whistle-blowing
  • Capped compensatory awards
  • The implementation of pre-termination discussions
  • The renaming of Compromise Agreements to Settlement Agreements
  • The implementation of Employment Tribunal fees
The changes are set to continue in 2014.

Recent Case Law - Housing

Leicester CC-v-Shearer 2013 (EWCA) Civ1467 (if you have been affected recently by loss of accommodation following the death of a family member then you may wish to take onboard the outcome of this particular case). 

The Defendant’s husband had been a Council tenant in succession to his mother. This means that when his mother died he was able to take on the tenancy with the consent of the Local Authority.  When he died there could be no further succession. Once the Defendant’s husband died the Council sought possession of the property and they wanted to evict the Defendant and their children. 

The Defendant correctly defended indicating that the decision to seek possession had been unlawful because the Council had failed to consider granting a new tenancy of the house as a “direct let” under the Exceptional Circumstances Act “provision in its housing allocation scheme”.  The Council argued that the Defendant had not made a formal application complying with its scheme.  The possession claim was dismissed.  The Council appealed to the Court of Law but this was also dismissed.  The Council had acted unlawfully when commencing possession proceedings against the Defendant without giving any or any proper consideration to the option of making a direct let.

The Launch of the Chester Food, Drink and Lifestyle Festival 2014 brought to you by Allington Hughes Law

Here at Allington Hughes we are very excited to announce that we will once again be sponsoring the Chester Food, Drink and Lifestyle Festival which is held at Chester Racecourse around Easter.

On the back of a fantastic event over the Easter Bank holiday this year we are thrilled to once again be joining the Festival and the thousands of people who come to seek the delights of locally produced food and drink.

In December last year we held the launch party for the event at our Chester office on Vicars Lane, however this year we scaled up and headed over to Bar Lounge in Chester. We were very pleased to welcome over 100 guests to celebrate our renewed association with this tremendous event and to sample some hot Cheshire mulled cider alongside some tasty accompaniments. 

The launch was a huge success and everyone at Allington Hughes would like to thank the guests who attended to make it such a wonderful evening.

In 2014 the 3 day Food and Drink Festival will be held from the 19th-21st of April at Chester Racecourse and is already on target to surpass all records and expectations set at this years event.  

It really is an occasion to put in the diary and we hope to see as many of you there as we did last year!

Wrexham Christmas Tree 2014

It is a long standing tradition at Allington Hughes to sponsor the Christmas Tree that sits proudly in the centre of Wrexham in Queens Square.

We are delighted to be doing so again this year and with the tree now standing tall in the centre of the town it is great to see so many people appreciating what a wonderful tree it is!

In the coming weeks, Wrexham County Borough Council and Allington Hughes will be running a 'Guess the Height' competition, which will give the people of Wrexham the opportunity to win a luxury hamper, just in time for Christmas!

New Housing Advice Drop In Clinic

With recent changes and cutbacks to Legal Aid, it has become increasingly important for people to know where they can access free legal advice.

Allington Hughes have gained a contract from the Legal Aid Agency to continue providing Legal Aid for Housing and Debt matters, which means we are the only firm of Solicitors in Wrexham to provide such a service.

In order to offer even greater access to this service, head of the Housing department and a Director of the firm Alison Stace has started a free drop in service for advice on all Housing matters. 

Starting this Friday 15th November from 10am to 4pm at our Wrexham office on 10 Grosvenor Road, anybody with a Housing matter can come into our Wrexham office and receive a free consultation with Alison or a member of the Housing team.

Rugby League World Cup 2013

This week Christiaan Roets of the Wales Rugby League World Cup squad and the North Wales Crusaders took some time out of his busy schedule to come and have a photo in our Wrexham office with Directors David Parry and Ian Lewis. 

As ever we are thrilled to be a part of Rugby League in the Wrexham area, and when we found out the biggest competition of all, the Rugby League World Cup was coming to Wrexham, we simply had to get involved. 

Working together with the North Wales Crusaders, we purchased 100 tickets to Sunday's match between Wales and the USA at the Glyndwr University stadium, and selected local primary school Barkers Lane to go and support the Welsh team and soak up the atmosphere. 10 lucky pupils will also get to parade around the pitch before kick off in front of what is sure to be a huge crowd, and hopefully they will catch the bug for watching the sport and maybe even giving it a try.

We are thrilled such a prestigious event has come to Wrexham and we will be there in force to support the Welsh team on Sunday afternoon! Good Luck Lads!

Fees Cut for Lasting Powers of Attorney (LPA)

Anyone applying to register a Lasting Power of Attorney (LPA) at the Office of the Public Guardian will now be helped by a 15% cut in the application fee announced by Justice Minister Helen Grant.

From 1 October 2013 the application fees for registering LPAs and the older Enduring Powers of Attorney (EPA) will both be reduced from £130 to £110.
LPAs and EPAs are legal documents which allow the applicant to appoint someone they know and trust to make decisions about their health and welfare or financial affairs if they were to lose capacity in the future.

 Justice Minister Helen Grant highlighted the importance of getting legal affairs in order;

'It is really important that people consider making a lasting power of attorney – it means that as they get older, or if they have issues with their health, they have the peace of mind from knowing that the important decisions about their life will be taken by someone they know and trust, if they ever lost capacity.'

Rod Spencer Joins Allington Hughes Law

Allington Hughes is thrilled to welcome another highly experienced solicitor to our team.

Rod Spencer has over 35 years of experience as a solicitor and practised on Hoole Road in Chester until retirement from sole practice in September 2013.

Rod will take up a role as consultancy solicitor in our Chester office as of 1st October, adding a great amount of experience and knowledge to the firm.

Rod has a particular interest in property transactions, wills and probate and all elderly client matters.

It is a real pleasure to welcome Rod to the firm and we wish him every success in his time at Allington Hughes.

The Tour of Britain 2013

From 15th - 22nd September 2013 the Tour of Britain is visiting various routes throughout the whole of  mainland UK. The race is split up into 7 different stages, and ensures that a huge amount of people have a great opportunity to get out and watch the tour, while catching a glimpse of some modern day sporting icons.

The race involves approximately 19 teams and over 100 individual riders, including British Olympian Mark Cavendish and Olympic champion and Tour De France winner Sir Bradley Wiggins (Wiggo to the fans).

Wednesday 11th September produced Stage 4 of the race, which consisted of a 188 kilometre ride from Stoke on Trent to the finish line in Llanberis, Snowdonia. This meant that a number of Welsh towns and villages got to witness the spectacular race pass through, and allowed for a fantastic show of support for both the event and the athletes involved.

At Allington Hughes we were lucky enough to have the race pass right by 2 of our offices. In Wrexham, the race flew down Grosvenor road and provided a fantastic spectacle for crowds of people to gather and enjoy the race.
Around the corner from our new JRL Law office in Llanrwst, the cyclists had to handle the tight tricky cornering of the small town, which provided some great opportunities to grab a photograph of some cycling giants. You can view our selection of pictures here.

The Tour of Britain has created a real buzz around the whole 7 day event, and it has been great to see the level of support and excitement generated when such a big event with world recognised sporting heroes visits the more rural locations of the UK.

We can only hope the route is unchanged for next year!

Ian Lewis Joins Allington Hughes Law

Denbigh and Flint Show Prize Draw

There were over 150 entries to this year's free prize draw at the Denbigh and Flint Show. The prize of a luxury hamper proved very popular and it was great to have so many people entering and excited about the possibility of winning.

Our very own Karen Schofield of the Chester office reception picked the Lucky ticket out of the hat after a good rummage through a brimming box of tickets.

Mr Ellis of Penymynydd was the lucky winner and he happened to be in the area to come into our office and collect his luxury hamper.

We run the competition every year and we hope to have even more entries at next years festival!

Legal Aid for Housing and Debt Matters

As Legal Aid has been subjected to considerable cutbacks over the last few months, it is important to share that Allington Hughes has been granted a Housing and Debt contract by the Legal Aid Agency to continue offering advice and assistance to those who qualify for public funding.

This will cover matters including:

  • Possession of the home (other than mortgage possession which is now referred to as debt);
  • Eviction from home (including unlawful eviction);
  • Seeking repairs to rented accommodation where the disrepair pose a serious risk of harm to health or safety;
  • Homelessness assistance for persons who are homeless or threatened with homelessness;
  • Injunctions under the Protection from Harassment Act 1997 in the context of housing and ASBO matters in the County Court.
The Housing team at Allington Hughes is highly experienced and like all departments at the firm takes great pride in being approachable and personable.

Denbigh and Flint Show 2013

This year Allington Hughes yet again shared a marquee at the Denbigh and Flint show with our friends over at Wright Manley. 

There were refreshments served throughout the day to welcome the hoards of people who flooded to the event in order to enjoy an array of various stalls and competitions.

We were delighted to see so many new and familiar faces in our tent and we hope that everyone we spoke to enjoyed the refreshments that were on offer. The day was a great success and everyone from Allington Hughes and Wright Manley would like to thank the organisers and everyone that attended on the day, and we hope to see you all next year.

The Rugby League World Cup Visits Allington Hughes

Allington Hughes were lucky enough to have the Rugby League World Cup stop by at our Wrexham office today.

With Wrexham being one of the hosts for the 2013 competition, the trophy is taking a whistle-stop tour of the town and being shown to the general public and a handful of local businesses. 

As one of the many sponsors of the World Cup in Wrexham, we are delighted that the town will get to witness some of the worlds greatest sporting talent as it plays host to two major games during the tournament. The first of those games will allow the whole of North Wales to get behind the home side as the Glyndwr University Racecourse Stadium will host Wales' Group D match against USA on Sunday November 3rd. 

The Rugby League World Cup is a huge sporting occasion, and it is of tremendous credit that Wrexham has been chose to be one of the hosts.

The annual Denbigh and Flint Show fall son Thursday August 15th this year at The Green in Denbigh.

Further Employment Law Updates - 29/07/2013

Employment Tribunal Fees

From 29th July 2013 there will be a fee for Claimants to issue claims and to have a claim heard in the Employment Tribunal.

There are two types of claim, Type A claims and Type B claims.

Type A claims are those less complex money claims e.g. breach of contract, redundancy pay, unlawful deduction of wages.

Type B claims are more complex claims e.g. unfair dismissal, discrimination, Whistle blowing.

The fees are as follows:-

Fee remission is available to those who cannot afford to pay the fees. This involves a three stage test.

  1. If you are in receipt of certain benefits (Income support, working tax credits, income based Job Seekers Allowance or income related Employment & Support Allowance) then you will receive a full fee remission.
  2. If you are not in receipt of any of the benefits outlined in 1 above then you may qualify for a fee remission based on the gross annual income test.  Full fee remission applies where your gross annual income is below:-

£18,860
£23,860

The sum of £2,930 will be added to the gross amount for each additional child

  1. If you do not qualify under test 1 and 2 above then you may be entitled to a partial remission of the Employment Tribunal fee which is based on your disposable monthly income
The Employment Tribunal fee or Fee Remission Form must be lodged with your Employment Tribunal Claim Form.  Original documentary evidence must be produced as evidence for fee remission purposes.  Without the necessary evidence the claim may be rejected and potentially fall out of time.

All claims in England and Wales together with the necessary payment or fee remission form will be lodged at Employment Tribunal Central Office, PO Box 10218, Leicester, LE1 8EQ

All claims in Scotland together with the necessary payment or fee remission form will be lodged at Employment Tribunals Central Office Scotland, PO Box 27105, Glasgow, G2 9JR

There is no fee for lodging a Response to a claim.

Other fees do however apply in connection with the review of default judgments (£100), counterclaims (£160), reconsideration of decisions (£100/£350) and Judicial mediation (£600)


If the Claimant is successful with his/her claim he/she will be entitled to claim the issue and hearing fee back from the Respondent.

North Wales Crusaders Win The Northern Rail Bowl 2013

North Wales Crusaders became the first team to have their name engraved on the The Northern Rail Bowl after a 42-24 victory over London Skolars on Saturday 20th of July.

The Shay Stadium in Halifax hosted over 4000 spectators who witnessed an enthralling game of Rugby League that saw the teams locked at 16-16 at the halfway stage. After the break and a few motivational words from the Coach and Captain, the Crusaders managed to rally and added another 26 points to their total which proved enough to clinch victory.

Allington Hughes enjoy a strong bond with the Crusaders, with partner of the firm Ian Edwards also being a Director and Chairman at the ever improving Rugby League outfit. The club captain, Andy Moulsdale, is also sponsored by Allington Hughes and we take great pride in getting involved as much as possible with the club at every opportunity.

There are increasing levels of support on match days from staff at Allington Hughes due to glowing reviews of fantastic atmosphere among the fans and a refreshing willingness from the Crusaders players to meet and socialise with their supporters after the matches.

A huge congratulations from everyone at Allington Hughes on the success achieved by the North Wales Crusaders this weekend, and long may it continue.

Additional Employment Law Update

More changes in Employment Law set to be imposed on the 29th July 2013

The 29th July is already set to be the date where numerous regulations will be imposed or varied.  These changes were set out in our “Employment Tribunal Rules & Procedures 2013 update”

It has now been confirmed that the 29th July will see yet more changes these being the implementation of s14 of the Enterprise & Regulatory Reform Act 2013 which will allow for pre-termination negotiations and also the re-naming of Compromise Agreements to Settlement agreements.

What this means is from the 29th July 2013 s14 of the Enterprise & Regulatory Reform Act will allow employers to hold discussions with employees with a view to terminating their employment under a Settlement Agreement.  Pre-termination discussions could even be where there is no formal dispute between the employer and employee.  The new s14 regulation goes further therefore than the current “without prejudice” principle currently in place.

The Employee will not be able to rely on the pre-termination discussions as evidence in an unfair dismissal claim. This protection does not however apply where there is a claim for automatic unfair dismissal or discrimination claim. If “anything said or done which in the tribunal’s opinion was improper, or was connected with improper behaviour” then evidence is inadmissible only “to the extent that the tribunal considers just”.

Improper behaviour will include all forms of harassment, bullying, intimidation, violence and putting undue pressure on the employee.

Employment Law Changes 25/6/2013

June 25th 2013 sees yet more changes in Employment Law.

The changes are in accordance with the Enterprise and Regularly Reform Act 2013 (ERRA 2013) and primarily relate to the rules on Whistleblowing.

The Public Interest Disclosure Act 1998 introduced protection for whistleblower which had many flaws. 15 years on and today marks the day some of the flaws have been rectified.

The changes include:-

1. A requirement that any disclosure be in the “reasonable belief of the worker” and be  “in the public interest”. 

2. The requirement for the disclosure to be “in good faith” has been removed. In effect this could mean that whistleblowing claims that are vexatious and motivated by spite could be brought as long as (1) above is satisfied.  It should be noted that where a vexatious claim is brought the Employment Tribunal has the power to reduce an award by up to 25%. 

3. Employers will now be vicariously liable for detriments by employees.  There will be a statutory defence available in such circumstances similar to that available under the Equality Act 2010 i.e. all reasonable steps have been taken to prevent such behaviour

4. There are also changes to the meaning of “worker”

Other changes being implemented under the ERRA 2013 and the Employment Rights Act 1996 include:-

1. Employment Appeal Tribunal judges will sit alone

2. The qualifying period for unfair dismissal not to apply where the main reason for dismissal is the employee's political opinions or affiliation

3. The Compensatory Award to be capped at the lower of £74,200 or 52 week’s pay and the power to vary the unfair dismissal compensatory award further

4. The power to make regulations allowing tribunals to make deposit orders in relation to part only of claim or response, and award both preparation time and witness expenses to litigants in person

5. Changes to the way in which increases to the limit on a week's pay and other tribunal awards are calculated

6. The power to make caste an aspect of race discrimination

7. The abolition of the Agricultural Wages Board for England and Wales

Save UK Justice


An e-petition has been drafted in order to try and force a debate in parliament regarding the threat to the provision of legal aid services contemplated by the Government. 
Not only are there plans to reduce access to justice by depriving citizens of legal aid or the right to representation by the Solicitor of their choice, but large public funding cuts will also have a massive effect on the legal services industry.
It is of great importance that matters which carry so much consequence such as this should be decided on the back of correct and formal debate within parliament and not decided without reasonable questioning.
This petition needs 100,000 signatures to force through a debate in parliament; so please feel free to have a read over the finer details and if you feel the same as we do, please sign the petition.

Give and Gain Day - Wrexham 2013


Queensway sports stadium in Wrexham played host to over 400 school children in a 'Give and Gain' day last week. The day was part of the national Business In The Community (BITC) scheme which encourages businesses to send employees to assist in a day of volunteering.

On this occasion, with the Rugby League World Cup coming to Wrexham in the summer, the North Wales Crusaders Rugby League team also offered their help in order to teach the children some basic Rugby skills.

We were lucky enough to be invited along due to our close relationship with the Crusaders, and it was a fantastic spectacle to witness. Great credit must be given to all of the businesses who supplied volunteers to make the day a success, along with Wrexham County Borough Council and the North Wales Crusaders. It was brilliant to see such an event thriving in the middle of Wrexham.

Go Wales 10th Birthday Celebrations

A celebration was held at Glyndwr University on Friday 10th of May to mark the 10th anniversary of the Go Wales graduate work scheme.

The scheme has aided almost 6500 graduates in gaining vital experience in employment while securing approximately 80% of those graduates a full time position post completion of the placement.

Allington Hughes were invited to the celebration in order to receive an award for being one of the 650 businesses involved with the scheme. Marketing Consultant Louie Middlehurst completed a 10 week work placement at the firm towards the end of November 2012 and has since retained a full time position.

We think it is important to contribute to the development of local talent, as highlighted by our long standing ethos of developing young people within the firm ready to maintain their role once fully qualified. Go Wales is a fantastic scheme that has a proven track record of producing credible, employment ready graduates to aid in the development of Welsh businesses.
